TERMS OF TRADE - GLENKRAG LIMITED


HOURS OF BUSINESS: MONDAY - THURSDAY 8.00am TO 5.30pm & FRIDAY 4.30pm

ORDERS for delivery the following day and additions to existing orders cannot be guaranteed delivery if accepted after 12.00 noon of the day prior to delivery.
PRICES charged will be those in effect at the date of despatch. Due to continuous Product development we reserve the right to amend specifications and Prices without prior notice. Advertisements, catalogues and other written material are only intended to present a general indication of Products referred to therein and in no part shall be binding on Glenkrag Ltd.
DELIVERY the minimum order for free delivery within our scheduled routing is £150.00 Sterling. / €245 excluding VAT. Orders despatched outside our normal delivery routes will be charged carriage at cost.
Delivery to UK mainland via courier, minimum orders shall be £350 ex VAT + £35 ex VAT delivery. Orders exceeding £500 ex VAT, delivery will be free.
TERMS OF PAYMENT All goods are delivered strictly Cash on Delivery unless otherwise agreed and will remain so until such times as Bank and Trade references have been cleared. Payments made by credit card will be subject to a handling charge of 3%. Switch or Debit cards are also accepted. Payment by cheque will only be accepted after Bank and Trade references have been cleared. If payments are not made in accordance with our terms, goods will not be left and no further orders will be accepted until payment has been received.
RETURNED CHEQUES Any cheque returned by our Bank "Refer to Drawer, Please Represent" will be subject to Bank charges and an administration charge. Further orders will not be delivered until the cheque has been met. If a cheque is returned "Refer to Drawer", further orders may only be accepted on a Cash or Bank Draft basis and only when any outstanding debt has been cleared.
OVERDUE BALANCES Glenkrag reserve the right to charge the customer interest on any overdue amounts at 8% per month above the Bank of Ireland base rate from the due date until actual payment before and after any judgement, calculated on a daily basis and compounded monthly. Where payments are not received and where it is necessary for such debts to be placed in the hands of an external third party for collection or other Legal process, then Glenkrag reserves the right to call for charges incurred in this process, to be paid by the customer in addition to any or all sums due at that time.
RESERVATION OF TITLE Title to the goods shall not pass to you until payment in full has been made to us. In respect thereof and until title shall pass you have the goods in your possession and at your risk solely as bailee for us. Such bailment shall be deemed to terminate forthwith if you, being an individual, commit an Act of Bankruptcy or being a company, enter into liquidation, or have a Winding up petition presented against you, or a Receiver appointed, or in either case allow distress or execution to be levied against your property, whereupon we shall be entitled to enter onto any premises to resume immediate possession of the goods. If you dispose of the goods before title shall pass, you shall be deemed to do so as an agent for us and shall hold the proceeds of sale in trust for us.
DAMAGES ON DELIVERY Goods delivered in error or damaged MUST be reported to the driver before signing the consignment note. All glass aquariums and cabinet furniture must be inspected before the driver leaves your premises. Any items found to be damaged must be returned with the driver. No claims for damaged aquariums and cabinet furniture can be entertained after our driver has left your premises.
SHORTAGES All deliveries are customer coded and include the number of parcels for delivery. All orders are cross-checked on two occasions prior to despatch. 1. on completion of picking. 2. Number of parcels checked onto the vehicle. Small items may be placed into one box and will be included as one item in the count. Drivers are instructed to count all parcels off at each drop. Any parcel shortages must be notified in writing before the driver leaves the premises, otherwise credit will not be allowed. Other shortages must be notified within 24 hours of receipt of order.
RETURNS All returns are to be notified to the Sales Representative quoting the invoice number relating to each item. A collection note will then be raised. Upon receipt and checking of returns, damaged goods will be replaced or credited. Any items returned as not ordered or for any other reason will only be credited if on inspection the goods are found to be in such condition as to afford re-sale. Glenkrag Ltd reserves the right to charge a handling fee of 15% in such circumstances. The customer shall not be entitled to withhold payment correctly invoiced by and due to Glenkrag Ltd. because of any disputed claim.
LIVESTOCK (Tropical & Cold Water Fish) are guaranteed Live on delivery. We will not despatch any fish found to be out of condition. Fish inspected on arrival and found to be in good condition and signed for, shall not be credited in the event of a subsequent claim. In all other cases DOA'S MUST be reported within 24 hours of delivery either by Telephone, Fax or in writing with a postmark dated within the 24-hour period. (Fish House Help Line No. 028 93359507)
LIVESTOCK (Marine Fish, Invertebrates, Corals & Live Rock) are guaranteed Live on delivery and must be inspected by the customer on delivery. Any aforementioned Marine that the customer is not happy with can be returned with the driver for full credit. Once they are accepted Glenkrag will not accept the aforementioned Marines back at a later date nor will we accept any responsibility if they die after the customer has accepted them.
LIVESTOCK (Reptiles) all Reptiles must be inspected on arrival. Any animal that the customer is not happy with can be returned with the driver for full credit. Once the animal is accepted Glenkrag will not accept the animal back at a later date nor will we accept any responsibility if it dies after the customer has accepted it.

Glenkrag Ltd. shall have the right to close or suspend any account or withhold delivery if:

1. The customer fails to pay any sum due in accordance with the terms of trading.
2. The customer goes into liquidation or has a receiver appointed or commits any act of insolvency.
3. Glenkrag Ltd. has any reason to doubt the credit worthiness of the customer.
4. The customer no longer meets the necessary Trade requirements or the level of business is no longer deemed viable.
